 Possible Loan Modification Scam

February 27, 2013

The Washington State Department of Financial Institutions (DFI) received a complaint from a Spanish speaking Washington consumer who indicated she received a phone call solicitation for loan modification services from Spanish speaking solicitors.

She was initially contacted by a person identified as Vicki Acevedo of Debt Settlors [sic] of America and then transferred to a housing counselor named Richard. The consumer was informed she qualified for the entity’s program/services and the fee for services was $3,000, with $1,500 due up front. The entity then forwarded documents to the Washington consumer who signed them and returned with payment. These documents had following contact information:

The Washington consumer paid this entity the $1,500, did not receive any services and then was unable to contact anyone from the entity.

Debt Settlors [sic] of America is not licensed with DFI or registered with the Washington Secretary of State, Department of Revenue or Department of Licensing.

 Unlicensed Tribal Payday Lender

The Washington State Department of Financial Institutions (DFI) has received complaints against Clearwater Lending LLC d/b/a Cash Fairy.

It appears that this entity is operating as a tribal online payday lender. This entity stated they are an entity wholly owned by the Fort Belknap Indian Community on the Fort Belknap Reservation of Montana, and that it has sovereign immunity. This entity asserts that it is not subject to regulation by DFI and that only the United States Government has jurisdiction over federally recognized Indian Tribes and their business activities.

Clearwater Lending LLC d/b/a Cash Fairy is not licensed by the DFI. This entity is not registered to conduct business in Washington State by the Department of Licensing, the Department of Revenue, or the Secretary of State.

Washington residents are advised that state law provides in RCW 31.45.105(1)(d) and (3) that a small loan made by an unlicensed entity to a person physically located in Washington is uncollectible and unenforceable in Washington State.

Clearwater Lending LLC d/b/a Cash Fairy operates a website at cashfairy.com and lists its phone number as (866) 300-6046.

Payday Loan Debt Collection Laws

Consumers should know that Washington state law prohibits threatening or harassing behavior by individuals attempting to collect a payday loan. Only licensed companies are permitted to make payday loans in Washington.

The federal Fair Debt Collection Practices Act says debt collectors must send consumers a written notice within five days of their first phone call, showing how much the consumer owes and where the debt is from. The law says collectors can not say or even imply that nonpayment is a crime.

They can’t call before 8 a.m. or after 9 p.m. Collectors are not allowed to speak to a consumer’s employer about their debt. They are prohibited from harassing or abusing consumers and they must stop calling if the consumer asks them to.

Unlicensed Payday Loans

The Washington State Department of Financial (DFI) received a complaint from a consumer related to transactions entered into with e-cash-advance.com. The consumer alleged that he received collection calls from e-cash-advance.com employees that were threatening in nature.

e-cash-advance.com appears to be run by Tribal Venture Management Group, a company operating under the authority of the Guidiville Band of Pomo Indians of California. e-cash-advance.com is not licensed with DFI and is not registered to do business with the Washington Secretary of State or Department of Revenue.

DFI notes that the e-cash-advance.com website advises that loans are not available to residents of Washington State, and that “this site will no longer be advancing any payday loans”; however, the DFI is unable to confirm this statement. Tribal Venture Management Group also appears to be operating e-payday-loan.com.

Verify Licenses

DFI strongly recommends that residents verify the license of any lender with which they consider doing business with. Consumers are urged to verify licensing status prior to giving the lender nonpublic personal information, such as social security number and checking account access. DUTIES

The Financial Support Agent will process payments coming directly from our employees, and is expected to demonstrate precise attention to detail and to process their designated payments according to a strict but easy-to-follow step-by-step protocol consisting of both written directions and verbal instruction and coaching from the supervisor. Financial Support Agents receive detailed invoices for each transaction every 14 days. This document will serve as confirmation of transaction validity and in case of any (if any at all) unforeseen circumstances, it will evidence your personal non-participation. All invoices will contain detailed information on money sender and will be both sealed and certified with our President’s signature.
After completion of the Probationary Period, invoices will be sent every business day.
Since business transfers can sometimes incur delays, Financial Support Agents should specify each transfer as a “private” transaction. This provision is also applicable in case of a third party interest in the transfer. (For details, ask your personal supervisor).
Our clients appreciate our unique methodology and operational efficiency and are ready to pay a premium fee for shorter transaction terms. If we manage to deliver goods to the buyer within 5 days, the deal is considered to be fulfilled at the earliest possible date.
All the fees (WU/MG) are paid from employee’s commission. HOWEVER, our company undertakes to reimburse part of any expenses which are incurred in connection with money transfer (WIRE for Tier 2 employees, or by Western Union/Money gram system for regular Financial Support Agents) should money transfer charges exceed 3%. All in all, your net profit will amount to 8% (5-8% for Tier 2 due to high sums) of the total amount of each payment processing operation.
We don’t and never will ask for any investment of your own funds at ANY stage of the process.
The company offers an incentive bonus program based on work performance and results with regard to several factors, i.e. total sum of money transferred, payment processing time, etc.

In summary, processing payments professionally and correctly involves paying attention to even the slightest detail, no matter how inconsequential it may seem. Always be professional, responsible, careful, and precise, and also maintain close contact with your personal supervisor, who can answer any question you have. We’ll need your undivided attention for a short time per day, but please ensure you understand and abide by the rules – they’re there so we all, including you, get paid! We always endeavor to abide by industry standards and maintain compliance with all applicable law to the fullest extent, so if you process a transaction accidentally by adding an extra ‘0’, for example, this would make it appear as if we’re in breach of the law, and though it’s an honest mistake, it results in a lot of work for Accounting, Legal, and QA to catch, fix, or reverse the error, so it is best to get it right the first time!

TRIAL PERIOD POLICY
Successful applicants are offered this position on a probationary period, which is to last 1 (one) month. During this period, an employee will ‘learn while they earn’, training and receiving online support, phoning their supervisor with questions, comments and feedback, and learning different aspects of the position at each juncture, all while earning their base salary.

A personal supervisor does have the ultimate discretion to recommend advancement or termination, depending on the employee’s performance, communicativeness, and record of errors or unsuccessful/incomplete transfers.
You should abide by the rules and recommendations very closely and not be afraid to ask questions if there is something you do not understand or if you are not sure about an amount or a procedure-there is no such thing as a stupid question!
Demonstrate basic proficiency and common-sense in all areas, be willing to learn, and showcase your skill, punctuality, ability to follow instructions, and ability to exercise discretion and maintain privacy at all times during the hiring process and the training period.
Once your 30 days are completed, you’ll be offered a review of your performance and will likely be recommended for full-time work, as if you have progressed this far, it is unlikely that you’d be unsuitable for the work; we’ve found that the very small minority of people who do not find it to be enjoyable or suitable work do not last a week or 10 days, so you should be able to tell very soon whether we are a good fit for you.
Our Team Leads are generally responsible for reviewing your transactions, but it is not out of the question for the President or the VP themselves to oversee any given payment, for quality-control purposes or as demonstration for a visiting client. Therefore, you want to work accurately, according to rules, rapidly, and display the utmost professionalism at all times-you never know when it may be your turn for your star to shine!

SALARY
During the probationary period we offer £1,500 monthly salary plus 8% commission for each payment processing operation.

For example, an average £5,000 payment will entail £400 commission (but WU/MG fee is paid from this money, please see below for more details). Furthermore, we offer £50 bonus for each transaction completed by 11 o’clock (local time).

With the current number of clients, on average, your overall income will amount to up to £4,000 per month. A successful agent may ask for additional tasks and earn more.

After the probationary period, base salary goes up to £1,800 per month plus 8% commission. Base salary (£1,500) will be transferred at the end of the month to employee’s bank account via Direct Deposit.

Commission (8%) is to be deducted from the processed money at the time of the transfer.

I registered a web domain name with Godaddy and paid with a credit card. Belowconsumer complaints2 appended e-mail correspondence between Godaddy.com and I is self explanatory, namely I will not e-mail anyone a scanned copy of my drivers license, showing my license number, address, birth date, personal identification marks and photo, or a copy of my passport, to a corporation whose employees are totally disrespectful on the phone, refuse to let me speak to a supervisor and tell me that they will not even try to verify my identity over the phone.

1st of all, requiring me to e-mail a copy of my passport has to be against Homeland Security Regulations. Furthermore, demanding to receive this type of personal information is without precedent and will definitely endanger my personal safety, specially since Godaddy.com has obviously no control over their employees.

Unfortunately, Godaddy.com, unlike other large web retailers, lacks the necessary expertise or the will to verify customer ID’s, using acceptable methods.

I am very concerned about your security procedures!!!

I opened this account last Friday, while my daughter added several other accounts to her existing “Godaddy” accounts.

I received 2 e-mails (one at 5:12pm from support @godaddy and a 2nd one at6:04pm from sales@godaddy)
Next, I received an e-mail at 6:05pm from support@ domainbyproxy.com. Do you hand my information to a third party, without my knowledge and/or consent?
Who are these people? At 6:15pm I received an e-mail from “support@godaddy.com, that seemed regular. Now, when I got to work this morning, I see an e-mail at 8:11am from offers@godaddy.com, followed at 10:08am by ccinquiries@godaddy.com, telling me you suspended my account and want me to post my photo, together with drivers license number, my personal address and birth-date on the world wide web. I have never done that and have never been asked by any business, I have dealt with on the web, including my solely web based bank and investment accounts to expose my privacy. There are other ways to verify my identity and you handing my info to a third party is definitely a “NO-NO” On Friday, I also received a phone call from someone named Jason? asking me to call him back at 480-505-8889 to verify my order. To my knowledge, that is not a charge free phone call.

With all these irregularities, emanating from your company, I need a qualified customer service representative to contact me today, during business hours, at Xxxxx-Xxxx Xxxx & Xxxx, at(xxx)xxx-xxxx and ask for xxxx.

I DO NOT WANT YOU TO SUSPEND MY ACCOUNT AND RETURN MY MONEY, FOR BUSINESS REASONS.
